These terms and conditions govern your use of our website and your relationship with Sapori Direct Ltd. Please read these terms and conditions carefully.
By using our website or placing an order, you are agreeing to these terms and conditions and our Privacy & Cookie Policy. Each time you place an order with us, the Terms and Conditions in force at that time will apply.
Sapori Direct Ltd may revise these terms at any time by updating this page. You should check the website periodically to review the current terms, as they are binding on you.
1. DEFINITIONS
“You” and “Your” means anyone who uses the website or orders products from Sapori Direct Ltd.
“We”, “Us”, “Our”, or “Sapori Direct” means Sapori Direct Ltd.
“Website” means saporidirect.co.uk
“Products” means the food items and other goods offered for sale on our website.

4. THE PRODUCTS
4.1 We ensure that all Product ingredients and information stated on the Website comply with current UK laws and regulations.
4.2 You should read the ingredients and information on the Products carefully to ensure you do not purchase anything that may cause you harm because of food allergies or intolerances.
4.3 The images of the Products on the Website are for illustrative purposes only. While we make every effort to display the colours accurately, we cannot guarantee that your computer or mobile device’s display accurately reflects the true appearance of the Products. The packaging of the Products may also vary from that shown on images on the Website.
4.4 You may only purchase Products from our Website if you are at least 18 years old.
4.5 We are not allowed by law to supply certain Products to you if you do not satisfy the age requirements. If you are underage, please do not attempt to order these Products through our Website. These Products include:
4.5.1 Alcohol, which may only be bought by those over 18.
5. THE ORDER PROCESS
5.1 After completing checkout, you will receive an email acknowledging that we have received your order. This does not mean that your order has been accepted yet.
5.2 Once we have checked the order, we will send you an email confirming that your order is accepted and the goods have been dispatched (the “Order Confirmation”). This is when a contract (a “Confirmed Order”) is formed between you and Sapori Direct.
5.3 If we are unable to supply you with a Product, cannot meet your requested delivery date, or if there was an error in the price on the Website, we will email you and will not process your order until we have heard from you. If we don’t hear back from you within three days and you have already paid for the Products, we will refund you the full amount including any delivery costs charged as soon as possible.
6. CHANGES TO YOUR ORDER
If you wish to make a change to your order, please contact us within 24 hours of placing your order, and we will try to accommodate your request. It may not always be possible to make your requested changes.
7. YOUR CONSUMER RIGHT OF RETURN AND REFUND
7.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a legal right to cancel a Confirmed Order for any reason within 14 days of receiving the Product(s) (the “cancellation period”).
7.2 To cancel a Confirmed Order, please email us at hello@saporidirect.co.uk with your order details and your decision to cancel. You may use the following cancellation notice wording, but it is not obligatory:

7.3 We will email you to confirm receipt of your cancellation.
7.4 If you cancel your Confirmed Order we will:
7.4.1 Refund you the price you paid for the Products. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. In particular, some of our Products (e.g. olive oil) must be kept cool and out of direct sunlight. Please look after our Products so that we can give you a full refund.
7.4.2 Refund any delivery costs you have paid to us, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer.
7.4.3 Make any refunds due to you as soon as possible and in any event within 14 days after the day on which we receive the Product back from you or, if earlier, the day on which you provide us with evidence that you have sent the Product back.
7.5 We will refund you on the credit card or debit card used by you to pay.
7.6 If a Product has been delivered to you before you decide to cancel your Confirmed Order:
7.6.1 You must return it to us without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the Confirmed Order.
7.6.2 Unless the Product is faulty or not as described, you will be responsible for the cost of returning the Products to us.
7.6.3 If you have returned the Products to us because they are faulty or mis-described, we will refund the price of the Products in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the items to us.
7.7 If the Products have been damaged in transit during delivery to you, please let us know immediately and send us a picture if possible, so that we can claim a refund from our couriers. We will get replacement Products to you as quickly as possible, as long as the products in question are still available.
7.8 You have legal rights in relation to Products that are faulty or not as described. These legal rights are not affected by your right of return and refund or anything else in these Terms.
8. DELIVERY
8.1 Occasionally our delivery to you may be affected by Events Outside Our Control (see section 13).
8.2 We will contact you with an estimated delivery date, which will normally be within 5 working days after the date of the Order Confirmation.
8.3 If no one is available at your address to take delivery, the carrier will leave you a note with instructions for redelivery or collection.
8.4 Delivery of an order is completed when the Products are delivered to the address you gave us, and the Products will be your responsibility from that time.
8.5 We deliver to the UK mainland only. Deliveries to Northern Ireland, Scottish Highlands and Islands, Isle of Man, Isle of Wight, Channel Islands, and other UK offshore locations may incur additional charges or may not be available.
9. PRICES AND PAYMENT
9.1 The prices of the Products will be as quoted on our Website at the time you submit your order. The prices include VAT where applicable but exclude delivery charges, which are added at checkout.
9.2 We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system. However, if we discover an error in the price of the Products you have ordered, we will contact you to inform you of this error and give you the option of continuing to purchase the Product at the correct price or cancelling your order.
9.3 Prices for our Products may change from time to time, but changes will not affect any order you have already placed.
9.4 Payment for all Products must be made in advance by credit or debit card or other payment methods offered on the Website. We will not charge your card until we dispatch the Products to you.
10. OUR LIABILITY
10.1 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable.
10.2 We only supply the Products for domestic and private use in accordance with the manufacturer’s instructions. You agree not to use the Products for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
10.3 We do not in any way exclude or limit our liability for:
10.3.1 Death or personal injury caused by our negligence;
10.3.2 Fraud or fraudulent misrepresentation;
10.3.3 Any breach of the terms implied by sections 9-11, 13-15 and 17 of the Consumer Rights Act 2015 (title, description, satisfactory quality, fitness for purpose, and samples); and
10.3.4 Defective products under the Consumer Protection Act 1987.
11. EVENTS OUTSIDE OUR CONTROL
11.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations for a Confirmed Order that is caused by an Event Outside Our Control, which includes any act or event beyond our reasonable control including strikes, civil commotion, terrorist attack, pandemic, natural disaster, or failure of public or private telecommunications networks.
11.2 If an Event Outside Our Control takes place that affects the performance of our obligations under a Confirmed Order:
11.2.1 We will contact you as soon as reasonably possible to notify you; and
11.2.2 Our obligations under the Confirmed Order will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.
11.3 You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will refund the price you have paid, including any delivery charges.
12. INTELLECTUAL PROPERTY
All rights, including copyright and other intellectual property rights, in and to this Website are owned by Sapori Direct Ltd.
13. OTHER IMPORTANT TERMS
13.1 We may transfer our rights and obligations under a Confirmed Order to another organisation, but this will not affect your rights or our obligations under these Terms.
13.2 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
13.3 If we do not insist immediately that you do any of your obligations under these Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
13.4 These Terms are governed by English law. This means a contract (Confirmed Order) for the purchase of Products through our Website and any dispute or claim arising from it will be governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction.
